Sam and his team represent insurers, insurance brokers and claim administrators in a wide range of commercial litigation matters arising out of large loss-sensitive insurance programs and guaranteed cost policies across all lines of insurance; errors & omissions across underwriting, coverage, claims handling and brokerage services; insurance coverage counseling and litigation; and complex claim defense. Sam understands both the business and legal aspects of national accounts, commercial insurance, and recurring issues raised by policyholders. His capabilities span every aspect of the insurance practice, such as retrospective premium formulas and calculations, large deductible formulas and calculations, allocated loss adjustment expense billing methods, coverage counseling and litigation, guarantee cost policies, premium audits, premium credits, dividends, claims handling and reserving, bad faith, experience modification factors and the impact on such factors from claims mismanagement, collateral draws and deficiencies, environmental and mass tort claim allocations across triggered policies, cost-share agreements and contribution claims, premium financing arrangements, broker and agency relationships, and reinsurance.

Sam regularly gives presentations to clients and trade associations regarding substantive law and effective litigation strategies. Sam also served as the expert witness for the prevailing party in a multimillion-dollar arbitration which centered on the parties’ strategies, decisions and actions in a commercial litigation matter involving a large retrospectively rated insurance program with allegations of pervasive claims mismanagement.

For over three decades, Sam has also practiced workers’ compensation law on behalf of employers. This practice is focused on the representation of self-insured employers and those with substantial risk retention in workers’ compensation matters and intentional wrong civil actions. This allows a thorough understanding of our clients’ businesses, personnel and operations, which we believe is critical to effective defense work. Sam’s workers’ compensation practice also makes him uniquely qualified to defend insurers and claim administrators in bad faith lawsuits and counterclaims involving allegations of claims mismanagement.

With over eighteen years of commercial litigation experience in state and federal courts across the nation, Dennis provides goal-oriented, practical solutions to his clients. Dennis has devoted his practice to the insurance and claims industries and has developed expertise in all aspects of commercial insurance products including retrospective premium formulas and calculations, deductible obligations, coverage counseling and litigation, environmental tort claim allocations, audit disputes, collateral, bad faith and claim mismanagement. His understanding of commercial insurance matters allows him to efficiently create leverage to achieve his client’s goals in the shortest time possible and in the most cost-effective manner. Dennis also focuses on all aspects of construction litigation, including defective design, professional negligence, accidents, defaults, and contract disputes. Clients recognize and appreciate Dennis’s natural ability to present complex facts and concepts in an easily understandable way which consistently results in the successful resolution of matters.

Prior to becoming an attorney, Dennis spent a decade working for a Fortune 500 company with direct involvement in sales, marketing, manufacturing, employment, and safety. Dennis now leverages his hands-on business experience to provide effective general counsel and litigation services for small to medium-sized businesses.

Dennis also advises self-insured employers and third-party administrators on a broad range of workers’ compensation issues. His experience with workers’ compensation claims provides him with valuable experience and insight making him well-positioned to defend his clients in bad faith lawsuits and counterclaims involving allegations of claims mismanagement.

Lisa focuses her practice on employment law on behalf of employers across multiple industries. Known by clients for her exceptional research skills, attention to detail and tenacity, she provides depth to the firm’s overall practice and expands the services that we can offer to clients.  Lisa represents our clients in direct employment actions, matters with employment practices liability insurance coverage, workers’ compensation cases, and commercial litigation.

Lisa began her career serving as a law clerk to the Honorable Marilyn Clark of the New Jersey Superior Court.  Following her clerkship, she spent several years working alongside the late Martin R. Pachman, a pioneer in the development of New Jersey public relations employment law and school law.

Lauren joined the firm following a clerkship for the Honorable Vincent J. Militello of the New Jersey Superior Court. The experience sharpened her research, writing and analytical skills, and exposed her to a wide variety of civil actions including commercial litigation, employment law matters, and insurance law disputes.

Lauren quickly became an integral member of the TK team and now serves as second chair on many of our most significant and complex litigation matters. These include disputes before courts and arbitration panels arising out of asbestos and other mass tort claims submitted for coverage under loss-sensitive insurance products with issues ranging from retrospective premium and large deductible obligations, proper allocation across triggered policies, per occurrence and aggregate coverage limits, cost-share arrangements, and contribution claims. Lauren also serves as second chair on a high exposure case brought by a group workers’ compensation self-insured trust against an insurance broker and third party administrator based on allegations of claim mismanagement, and two civil actions asserting intentional wrongs against an employer with punitive damages claims.
